ADEM Proposes Fine for Constellium

The Alabama Department of Environmental Management announced today they may fine Constellium in Muscle Shoals due to noncompliance with state laws.

The announcement states in part that pursuant to the provisions of the Alabama Environmental Management Act, Ala. Code §§22-22A-1 to 22-22A-17, as amended, the Alabama Department of Environmental Management is proposing to issue a Consent Order to Constellium Muscle Shoals, LLC, the owner/operator of a Secondary Aluminum manufacturing facility currently operating in Muscle Shoals.

The violations include failure to provide timely, complete records, accurately certify compliance, and conduct inspections as required by the Permit.

The Department is proposing a civil penalty in the amount of $75,000. The Order, if issued, would require Constellium Muscle Shoals, LLC, to pay the Alabama Department of Environmental Management within 45 days of the receipt date of the final Consent Order, and comply with the terms, limitations, and conditions of the Permit and the Department’s regulations according to the schedule outlined in the Consent Order.
